Section 1Who these terms are with

The Marvvi app and this website are operated by:

In these terms, "Marvvi", "we", "us" and "our" mean Edzilla Dev SRL. "You" means the adult account holder using the service.

Section 2Acceptance and eligibility

By downloading, creating an account in, or otherwise using Marvvi, you confirm that you have read, understood and agree to be bound by these Terms of Service and by our Privacy Policy. If you do not agree, do not use Marvvi.

• You must be at least 18 years old (or the age of majority where you live) to create a Marvvi account.
• You must be the parent or legal guardian of any child for whom you create a profile, and you consent on their behalf to the processing described in the Privacy Policy.
• Children may use Kids Mode under your supervision, but may not create accounts or accept these terms.
• You confirm you are not located in a country subject to an embargo that would make provision of the service unlawful.

You accept these terms in the app the first time you sign in. We keep a record of that acceptance, including its date and version.

Section 3What Marvvi does

Marvvi is a parental content-curation tool for iPhone and iPad. It allows a parent to:

• search for publicly available YouTube videos, or paste a YouTube link;
• hand-pick individual videos into playlists assigned to a specific child profile;
• hand the device to their child in a locked "Kids Mode" that plays only those approved videos;
• set daily screen-time limits and review what was watched;
• pair additional family devices that sync the same playlists and limits.

Marvvi is not a video hosting service, a broadcaster, or a content producer. We do not host, upload, store, download, transcode, or modify any video. All video content is owned by its respective creators and is delivered by YouTube.

Section 4Accounts, parent PIN and paired devices

• Accounts are created exclusively through Sign in with Apple or Google Sign-In. Marvvi does not use passwords.
• You set a parent PIN that guards access to the parent dashboard. You are responsible for keeping it confidential and for all activity that occurs under your account.
• If you forget your PIN, you can reset it using a one-time code sent to your account email address.
• You may pair additional devices to your family account. You are responsible for every device you pair and must unpair any device you no longer control.
• You must provide accurate information and keep your account email reachable. Notices we send there are deemed received.
• One account is for one family. You may not resell, share commercially, or transfer your account.

Section 5Use of YouTube API Services

Marvvi uses YouTube API Services. Two distinct official YouTube interfaces are used, and both are covered by these terms:

Marvvi accesses public data only, using an API key. Marvvi does not request any YouTube OAuth scope and does not access your YouTube account, watch history, subscriptions or any other "Authorized Data".

Section 6YouTube usage rules you must follow

When using Marvvi you may not:

• download, copy, record, cache offline, or otherwise store YouTube audiovisual content;
• block, skip, mute, remove, obscure, interfere with or in any way circumvent advertising served by YouTube, or any part of the YouTube player;
• separate, isolate, or modify YouTube audiovisual content from its player, or play it in the background outside YouTube's permitted behaviour;
• use Marvvi or YouTube content for any commercial purpose, including public performance, resale, or use in a commercial venue, without the necessary rights;
• use Marvvi to create a competing service, to scrape YouTube data, or to build an independent index or database of YouTube content;
• attempt to circumvent Marvvi's API quota, rate limits or technical protections.

YouTube reserves the right to change or discontinue its API Services at any time. If YouTube's terms and these terms conflict as to your use of YouTube content, YouTube's terms prevail.

Section 7Free plan and Marvvi Pro

Marvvi is free to download and use, with the following limits on the free plan:

If a Marvvi Pro subscription ends and your account exceeds the free limits, the excess content is paused, not deleted: it is hidden from your child and shown to you with a lock icon. Restoring Marvvi Pro reactivates it immediately, along with any screen-time limits that were made dormant.

Section 8Billing, renewal and refunds

• Marvvi Pro is offered as an auto-renewing subscription at USD 7.99 per month or USD 59.99 per year. Prices in your local currency are shown in the App Store before purchase and may vary by territory and applicable taxes.
• Payment is charged to your Apple ID at confirmation of purchase. Marvvi is distributed only through the Apple App Store; we never process your payment card and never see your payment details.
• Subscriptions renew automatically unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.
• You can manage or cancel at any time in iOS Settings → your name → Subscriptions → Marvvi, or via "Manage Subscription" in the app. Deleting the app does not cancel a subscription.
• Cancelling stops future charges; the current paid period runs to its end. Any unused portion of a free trial, if offered, is forfeited when a subscription is purchased.
• Refunds are handled solely by Apple under the Apple Media Services Terms and Conditions. We cannot issue refunds for App Store purchases. Request one at reportaproblem.apple.com.
• EU consumers: by starting a subscription and gaining immediate access to the digital service you expressly request immediate performance and acknowledge you thereby lose the 14-day right of withdrawal for the portion already supplied, in accordance with Directive 2011/83/EU.
• Your subscription is tied to your Marvvi account and applies to every device paired to your family, including expiry and cancellation status. Use Settings → Restore Purchases on a new device.
• We may change prices. Existing subscribers are notified in advance and price changes apply only from the next renewal, which you may decline by cancelling.

Section 9Acceptable use

You agree not to:

• use Marvvi for any unlawful purpose or in breach of any applicable law;
• reverse engineer, decompile, disassemble or attempt to derive the source code of the app, except to the extent this restriction is prohibited by law;
• interfere with, overload or disrupt our servers, or attempt to gain unauthorised access to any account, system or data;
• use automated means to access the service, or create accounts in bulk;
• share or resell access to your account, or use the service to provide a service to third parties;
• remove, obscure or alter any proprietary notice in the app;
• expose a child to content you have not reviewed, or use Marvvi to deliver content that is unlawful or harmful to minors.

We may suspend or terminate accounts that violate this section.

Section 10Parental responsibility for content

Marvvi is a tool that gives you control; it does not replace your judgement.

• You choose every video. Nothing appears in your child's playlist unless you add it. There is no automatic recommendation feed.
• Marvvi applies YouTube's safeSearch=strict filter to search results and blocks videos YouTube flags as age-restricted, but no automated filter is perfect. Final responsibility for the suitability of any video rests with you.
• Video content can change after you add it. A creator may edit, re-upload, monetise, make private, or delete a video, and YouTube may change what is shown around it. We are not responsible for such changes and recommend you periodically review your playlists.
• YouTube may display advertising within its player. We do not control, select, or benefit from that advertising.
• Screen-time limits are an aid to supervision, not a security guarantee. Adult supervision is still required.

Section 11Intellectual property

The Marvvi app, name, logo, design, and all software and original content are owned by Edzilla Dev SRL and are protected by copyright, trade mark and other laws. Subject to your compliance with these terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the app for your family's private, non-commercial use. All rights not expressly granted are reserved.

Video content accessed through Marvvi belongs to its respective owners and is licensed to you, if at all, by YouTube under the YouTube Terms of Service — not by us. Playlist names, child nicknames and other content you enter remain yours; you grant us only the licence needed to store, sync and display them to your family.

Section 12Availability and changes to the service

We aim to keep Marvvi available, but we do not guarantee uninterrupted service. The service depends on third parties — in particular YouTube, Apple and our hosting providers — and may be interrupted by maintenance, outages, or changes those parties make. We may add, modify, suspend or discontinue features at any time. If we discontinue the service entirely, we will give reasonable notice and, where a prepaid subscription period remains, a pro-rata refund arranged through Apple where possible.

We may amend these terms. The "Last Updated" date reflects the current version. Material changes will be notified in the app and, where required, will need your acceptance. Continued use after changes take effect constitutes acceptance.

Section 13Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MARVVI IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY CONTENT FILTERING WILL BE COMPLETE OR ACCURATE.

Nothing in these terms excludes or limits rights that cannot be excluded or limited under mandatory consumer protection law. If you are an EU consumer, your statutory rights regarding conformity of digital services remain unaffected.

Section 14Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EDZILLA DEV SRL AND ITS DIRECTORS, EMPLOYEES AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR ANTICIPATED SAVINGS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, MARVVI — INCLUDING ANY THIRD-PARTY CONTENT VIEWED THROUGH THE SERVICE — WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IN ANY TWELVE-MONTH PERIOD SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR MARVVI IN THAT PERIOD, OR (B) EUR 50.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited by law. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

Section 15Indemnification

You agree to indemnify and hold harmless Edzilla Dev SRL against any claim, demand, loss, liability or expense (including reasonable legal fees) arising from your breach of these terms, your violation of the YouTube Terms of Service or any applicable law, or your misuse of the service. This does not apply to the extent the claim arises from our own breach or negligence.

Section 16Termination

By you

You may stop using Marvvi at any time. To end the agreement completely, delete your account in the app: Settings → Account → Delete Account & Data. This permanently deletes your account and all family data. Cancel any active subscription separately through your Apple ID.

By us

We may suspend or terminate your access, with notice where reasonably possible, if you materially breach these terms, use the service unlawfully, abuse the YouTube API integration, or if we are required to do so by law or by YouTube, Google or Apple. Where a breach is capable of remedy, we will normally give you a reasonable opportunity to fix it first. If we terminate without cause, we will refund the unused portion of any prepaid subscription period where legally required.

Effect of termination

On termination, your licence to use the app ends immediately and your data is deleted in accordance with the Privacy Policy. Sections 11, 13, 14, 15, 18 and 20 survive termination.

Section 17Privacy

Our handling of personal data — including what we collect, how long YouTube API data is cached, our sub-processors, children's privacy, and how you revoke access or delete your account — is described in the Marvvi Privacy Policy, which forms part of this agreement.

Section 18Governing law and disputes

These terms are governed by the laws of Romania and, where applicable, of the European Union, without regard to conflict-of-law rules. The courts of Romania have jurisdiction over any dispute.

If you are a consumer resident in the European Union, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of residence, and you may also bring proceedings in the courts of your own country.

Before going to court, please contact us at [email protected] — most issues are resolved quickly. EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr. We are not obliged to participate in dispute resolution before a consumer arbitration board.

Section 19Apple-specific terms

• This agreement is between you and Edzilla Dev SRL only, not with Apple. Apple is not responsible for Marvvi or its content.
• Apple has no obligation to furnish any maintenance or support for Marvvi.
• In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation.
• Apple is not responsible for addressing any claim by you or a third party relating to the app, including product liability, legal or regulatory non-compliance, or consumer protection claims.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and are not on any U.S. Government list of prohibited or restricted parties.

Section 20General

• Entire agreement. These terms and the Privacy Policy are the entire agreement between you and us regarding Marvvi and supersede any prior understanding.
• Severability. If any provision is held invalid or unenforceable, the remaining provisions stay in full force and the invalid provision is replaced by a valid one closest to its intent.
• No waiver. Failure to enforce a provision is not a waiver of the right to enforce it later.
• Assignment. You may not assign these terms. We may assign them in connection with a merger, acquisition or sale of assets, on notice to you.
• Notices. We give notice in the app or by email to your account address. You give notice by writing to [email protected].
• Language. The English version of these terms prevails in case of any translation discrepancy.
